Rehabilitation of Offenders

Nacro is a supporter of the Ban the Box campaign and recognises the contribution that ex-offenders can make to our organisation as employees and we welcome applications from all.

We understand that obtaining gainful employment enables people who have put their criminal past behind them to become productive, financially independent members of society.

We only ask those applicants who have been selected for interview to make a confidential declaration in the form of a written disclosure statement (about a relevant criminal record). All information disclosed will be treated in the strictest confidence.

Applying for roles that are covered by the Rehabilitation of Offenders Act

If you are applying for a role that is covered by the Rehabilitation of Offenders Act 1974, Nacro will require applicants to disclose any unspent convictions. Further information about which roles are covered by the Act and when a caution or conviction becomes spent can be obtained from Nacro’s Resettlement Advice Service.

Applying for roles that are exempt from the Rehabilitation of Offenders Act

If you are applying for a role that is exempt from the Rehabilitation of Offenders Act 1974, Nacro will require applicants to complete a confidential declaration in relation to any convictions, cautions, reprimands and final warnings that are not ‘protected’ (i.e. eligible for filtering*) as defined by the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (Amendment) (England and Wales) Order 2013. A criminal record check appropriate to the role applied for will also be made with the Disclosure and Barring Service (formerly the Criminal Records Bureau).
Guidance and criteria on the filtering of these cautions and convictions can be found on the Disclosure and Barring Service website.

It is important that all applicants understand that it is a criminal offence to apply for a post if you have been disbarred, in law, from applying for it. Further information can be obtained from Nacro’s Resettlement Advice Service.

*Following amendments to the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (Amendment) (England and Wales) Order 2013 that were implemented on 29 May 2013, certain spent convictions and cautions are now protected (i.e. filtered from standard or enhanced DBS checks) and are therefore not subject to disclosure to employers, and cannot be taken into account.
